These Legal Conditions govern the access and use of the www.gomadridpride.com Website (hereinafter, “the Website” or “goMadridPride”), as well as the purchase of products or services through it.

By accepting these Legal Conditions, the User declares:

• That it assumes all the obligations set forth herein.

The data entered by the User, registered or not, must be accurate, current and truthful.

The User will be responsible at all times for the custody of their passwords, assuming consequently any damages that may arise from their improper use, as well as the assignment, disclosure or loss thereof. For these purposes, access to restricted areas and / or the  use of services and contents made under the password of Registered User will be considered made by said Registered User, who will respond in any case for such access and use.

1.7. Rules of use of the Website

The User undertakes to use the Website and all its content and services in accordance with the provisions of the law, morality, public order and these Legal Conditions. Likewise, it is obliged to make appropriate use of the Services and / or contents of the Website and not to use them to carry out illicit or criminal activities, which violate the rights of third parties and / or that infringe the regulation on intellectual and industrial property, or any other rules of the applicable legal system.

By way of example, and in no case limiting or excluding, the User undertakes to:

• Not to impersonate other Users using their registration keys to the different services and / or contents of the Website.
• Not to disseminate, transmit or make available to third parties any type of information, element or content that supposes a violation of the rights of intellectual and industrial property, patents, trademarks or copyright that correspond to the owners of the Website or to third parties.
• Not to disseminate, transmit or make available to third parties any type of information, element or content that supposes a violation of the secrecy of communications and the legislation of personal data.

The User undertakes to hold goMadridPride harmless from any possible claim, fine, penalty or sanction that it may be obliged to bear as a result of the User’s breach of any of the aforementioned rules of use, reserving, in addition, goMadridPride the right to request compensation for damages that correspond.

1.8. Intellectual and industrial property

All the contents of the Website, including but not limited to texts, photographs, graphics, images, icons, technology, software and other audiovisual or sound content, as well as its graphic design and source codes, are the intellectual property of goMadridPride or third parties, without any of the exploitation rights recognized by current regulations on intellectual property over them being understood to have been transferred to the User.

The trademarks, trade names or distinctive signs are owned by goMadridPride or third parties, without it being understood that access to the Website attributes any right over them.

1.9. Links to Third Party Sites

The Website contains links to sites managed by third parties. These links are for informational purposes only. goMadridPride does not control these sites and is not responsible for their content, their privacy policy or other practices they may carry out. 1.10. Publishing Service

The Website is a tourist guide that presents Business, Premises and Events  of the city of Madrid and the community of Madrid.  It offers the User the possibility of publishing his Business, Local and  Event  of the city of Madrid and the community of Madrid.

To access this possibility, the User must fill in and send a form with data related to its publication.  The data entered must be accurate, current and truthful and respect the rules of use of goMadridPride. The User declares to stop copyright both on the texts and images sent through the form.

The User receives an email to the email address indicated to inform him of the receipt of his request.

goMadridPride reviews the application and decides to accept or reject it based on criteria related to its editorial line and its target audience. The User will receive an email to inform him of the decision.

1.11. License Grant to User Provided Content

The publication, transmission, upload, reproduction or making available by any means of User Provided Content will grant goMadridPride a free, non-exclusive, worldwide and perpetual license (with the right of sublicense) so that we can use, reproduce, display, display, adapt, modify, publish or distribute said User Provided Content, in whole or in part,  by any format or means, or using any type of technology (present or future), as part of or in connection with the Platform.

The User guarantees that the publication and use by us of the content he has provided will not violate the rights of third parties.

1.12. Nullity and ineffectiveness of clauses

If any clause included in these Legal Conditions is declared totally or partially null or ineffective, such nullity or ineffectiveness will only affect said provision or the part of it that is null or ineffective, subsisting these Legal Conditions in everything else, considering such provision totally or partially not included.

1.13. Indemnification

The User agrees to exempt, indemnify and hold harmless goMadridPride, as well as its officers, directors, employees and agents, from any claim, obligation, damage, loss and expenses arising from or in any way linked to their access or use of the Website, from their breach of these conditions.

1.14. Applicable legislation and competent jurisdiction

The parties submit, at their option, for the resolution of conflicts and waiving any other jurisdiction, to the courts and tribunals of Madrid.

 

2. General conditions of sale

2.1. Introduction

The general conditions of sale described below, in accordance with current regulations on Consumers and Users (hereinafter General Conditions), exclusively govern the contractual relations between the User and the Website.

goMadridPride may occasionally modify the articles of its general conditions, so it is advisable that these are read with each visit to the gomadridpride.com website.

These modifications are attributable upon publication on the Internet. Each purchase on the website is governed by the general conditions in force on the date of the order.

We consider that once an order has been placed, you will have accepted our general conditions of sale without reservation after having read them. By accessing the Website, you agree to respect them.

2.2. Products

goMadridPride has different types of products. This includes physical products entirely designed and created by us or third parties, and services related to publications; hereinafter referred to together as the “Products”.

We pay great attention to the information regarding the essential characteristics of the products displayed through extensive descriptions, properties and images.

All Products are subject to availability. This means that, although we strive to reflect stock availability, some of the Products may no longer be available for sale. In these specific situations, the User will be contacted, either by phone or by mail and if it is his wish, the purchase will be canceled resulting in the refund of the amount corresponding to the purchase made (in the case of payment in advance).

It is possible that, as a result of differences in image acquisition, display technology, or for any other technical reason, the Products may exhibit small differences in color, or some other minor variation.

Typographical errors or errors in product descriptions, or manifest errors appearing on the Website, do not generate any rights.

2.3. Place an order

Orders are placed from our Website.

The online ordering process is very simple:

2.4. Product prices

The sales prices indicated in each product sheet are always shown in euros with VAT included.

VAT will not apply for the Canary Islands, Ceuta and Melilla and countries outside the European Union, with some exceptions.

We do not sell our products to companies, except for services in the Publication category. Consequently, we do not apply VAT self-assessment for intra-community transactions.

We reserve the right to change our prices at any time. However, we undertake to apply the prices in force indicated at the time of placing your order.

All prices are valid except for typographical errors.

2.5. Sales and delivery area:

We sell our products, except products in the Publication category, in:

• all of Spain (Peninsular, Balearic Islands, Canary Islands, Ceuta and Melilla),
• all countries of the European Union,
• Monaco

We deliver the products sold in the same area.

The products of the Publication category are sold exclusively in mainland Spain.

Deliveries are made by the best carriers on the market: we partner with shipping agencies such as UPS, FedEx, DHL and Correos to offer the best possible shipping experience.

We also offer our order tracking page to make package tracking easier.

2.6. Shipping costs

Transport costs are 6 euros, FREE if the order exceeds 50 euros.

Shipping costs will be added at the end of each order for information of the user.

Outside the European Union, shipments may incur customs costs, depending on the country of destination. The rate may vary depending on the value of  the order, the country and other factors that are based on the product itself. The recipient User will be responsible for these fees.

2.7. Delivery times

Delivery times vary depending on the destination and the period of the year. In times of high demand, that deadline may be exceeded.

Most of our products are manufactured with on-demand production, everything is made to order, generating less waste than conventional manufacturing. Likewise, we protect our planet.

Estimated delivery time = Estimated handling time + estimated shipping time

Order handling time is 2-5 business days.

The estimated shipping time is:

• Mainland Spain: 3-4 working days
• Other areas: 5-20 business days

The estimated delivery time is an estimate only, not a guarantee. Here are some of the reasons why an order might be delivered later than planned:

• Manufacturing problems,
• Products out of stock,
• Shipping-related delays, such as failed delivery attempts, service interruptions, or adverse weather conditions.

However, we strive to meet estimates on delivery times for each order.

2.8. Payments: cards, PayPal

2.9. Product returns

We want you to always be satisfied with our service. We provide you with several methods to return an order that may not meet your needs.

 

Satisfied or Refunded for 14 Days

The User will have 14 days from the date of receipt of the order to make the return.

Only intact products (with all their accessories) that can be used for later sale can be returned and never a product that has already been used.

You will be refunded the price paid for the product, less any shipping costs.

The User will be responsible for the direct costs of returning the product.

Any return must be notified to prevail your right of withdrawal of purchase in a timely manner. It must be accepted by goMadridPride that will inform you:

• A return code that you will visibly note on the outside of the package you send us.
• The return shipping address

To request your return code you must complete and submit the Return Request form accessible in the footer of the website.

Any shipment without a return code will not be collected, returning to its origin. Do not forget to attach your proof of purchase to your shipment.

The amount will be paid within a maximum period of 48/72 working hours from receipt and after verifying and verifying that the product is suitable for subsequent sale.

The payment will be made in the same form of payment that was chosen when making the purchase.

Wrong Product

If a product other than the one requested by the User is delivered by mistake by goMadridPride, it will be withdrawn and the correct product will be delivered without any additional charge.

Incorrect address

Any shipping address provided by the User, incorrect or incomplete that produces a return and causes some expenses, said expenses will be borne by the User, as goMadridPride is unrelated to the return.

Corrupted package:

If the package comes in poor condition, notify the carrier and reject the package without opening it. The carrier will return it to us and we will send you a new one.

2.10.  Right of withdrawal – Products Publication

According to Article 45 of Law 47/2002 amending Law 7/1996 on exceptions to the right of withdrawal, the User acknowledges that a publication on goMadridPride constitutes, from the fact of the choice made by the same on the name and content, the supply of a personalized good within the meaning of the aforementioned article.

Thus, the User is expressly informed that he cannot, in application of this provision, exercise his right of withdrawal for the publication and / and all the products contractedin relation to that publication.
